Mahamosa’s Commitment: A Transparent, Honest and Informative Privacy Policy

Mahamosa is fully committed to having a transparent, honest and informative Privacy Policy. Mahamosa values and places the utmost importance on privacy of persons (collectively herein referred to as “Customer” or “Customers”) who shop or visit the Mahamosa website, including affiliated Mahamosa microsites (collectively hereinafter referred to as “Site”). Under this Privacy Policy, “personally identifiable information” specifically refers to information that can be used to uniquely identify, contact, or locate a single person or can be used with other sources to uniquely identify a single individual. Mahamosa maintains and protects the confidentiality of all Customer personally identifiable and non-personally identifiable information (collectively herein referred to as “Customer Information”), subject to the Terms and Conditions of Use, including this Privacy Policy. Applicability

Agreement

Customer’s use and/or visitation of the Site constitutes agreement to the Terms and Conditions applicable to and governing the Site, including, but not limited to, this Privacy Policy. This Privacy Policy does not modify or alter any applicable agreement you have or may have with Mahamosa. For example, our Terms of Use govern your use of our Site. If this Policy conflicts with any portion of those terms and agreements, those terms and agreements govern to the extent of the inconsistency.

Changes

Mahamosa reserves the right to change the Terms and Conditions, including the Privacy Policy, at any time without advanced notice. From time-to-time the Privacy Policy will change and it will promptly be updated on the Site to reflect any such changes and notification of the same shall be implied by any use of the updated Site. Mahamosa suggests and recommends to Customers to review and become familiar with the Privacy Policy, and to regularly revisit and review the Privacy Policy to remain up-to-date with our most current privacy, confidentiality and security policies, processes and procedures.

Customer Information

Mahamosa collects Customer Information during the normal course of business when Customers use our services, including when purchasing our products, interacting with the Site and communicating with our employees, namely our customer service and sales representatives. All Customer Information collected is used strictly for business purposes only, namely to better serve Customers by improving and enhancing the Mahamosa experience. In some cases Customer Information may be aggregated and analyzed for business purposes. All Customer Information collected by Mahamosa is owned by and the property of Mahamosa. For complete transparency, we detail below specific instances in which Mahamosa collects Customer Information, including who, what, when, where, why and how Customer Information is collected. The detail provided is for illustrative purposes only and is not exhaustive. Other instances may exist in which Customer Information is collected and used. Account creation/registration

Mahamosa collects and receives Customer Information when a Customer creates or registers an account on the Site.

How is Customer Information collected?

Customers provides Customer Information when inputting information in various fields as prompted by the system at the Checkout page and our system stores the information in a database on our secure hosted servers. As to type and number of products and/or services ordered, such information is collected and received when a Customer selects various products and/or services thereby placing them in the Shopping Cup to be later purchased at Checkout.

The Customer Information is collected so that a Customer Service representative may facilitate the Customer with his or her shopping experience, including, but not limited to, taking an order over the telephone, assisting with an online order, and resolving order issues. Customer Service may request Customer Information to verify and validate a Customer’s identity for purposes of security. How is Customer Information collected?

Customer Information is collected automatically by our Site’s system using standard and ordinary technology practices in the e-commerce retail industry, including, but not limited, to use of cookies, web beacons, and/or other tracking mechanisms. A "cookie" is a small data file that the Site transfers to a Customer’s computer for storage to allow the Site’s server to retrieve specific Customer Information. Customers can disable some cookies, but the Site will not necessarily function as designed. For example, cookies must be enabled to register or make purchases. Additionally, analytic service provider(s) of Site click-stream and cookie data may assist us by using cookies and action tags such as single pixel gifs or web beacons to track aggregate and individual Site usage, and advertising effectiveness. Marketing Activities

Our marketing and promotion activities may require the collection of Customer Information. Examples of marketing activities include our Tea-Mail newsletter subscription, surveys, special deals, discounts, and/or exclusive offers.

What information is collected?

Any Customer Information required may be collected. For example, our Tea-Mail newsletter subscription requires a Customer provide both name and e-mail address.

How is that information collected?

Generally the Customer will provide the information depending on what information is requested by the specific marketing and promotional effort. For example, for our Tea-Mail newsletter a Customer inputs the information into our Site’s system by entering name and e-mail in fields provided on the Site’s homepage.

Mahamosa may purchase the Customer Information from a third party. We may research and gather information from other websites such as third party operated web discussion boards, communication facilitation sites (e.g. Facebook, Twitter, etc.)

To learn more about our potential and actual Customers in order to optimize and personalize our marketing efforts, including informing our Customers about products, services and offerings of interest.

Confidentiality and Non-Disclosure

Mahamosa strives to maintain, protect and secure the confidentiality of Customer Information as required by applicable law. Mahamosa does not sell, trade, or rent a Customer’s personally identifiable information to other non-affiliated persons or business entities. Mahamosa’s general business practice is to keep confidential and not disclose personally identifiable information to third-parties except as provided in this Privacy Policy. Mahamosa may share Customer Information internally within our business, including affiliated companies. Mahamosa discloses personally identifiable information to third parties only in the following limited instances: for business-related purposes, including, but not limited to, product and service fulfillment (e.g. to delivery companies for shipping processing, banks and credit card companies for payment processing, and server hosting), facilitation and improvement of business operations, business transactions, legal compliance, and in connection with claims, disputes, or litigation; and for protective purposes, such as protection of persons from actual or potential harm in any form or manner, or in case of an emergency. Notwithstanding anything to the contrary herein, Mahamosa reserves the right to use its sole discretion in making any disclosure of personally identifiable information subject to applicable law. Non-personally identifiable information may be used and disclosed by Mahamosa at its sole discretion to the full extent permissible by law. Any non-personally identifiable information, including, but not limited to, any information, materials, suggestions, ideas, comments and/or reviews provided by Customers, is non-confidential, and by submitting it, Customers hereby grant Mahamosa an irrevocable and unlimited license for any purposes whatsoever, including to use, modify, reproduce, publish, broadcast, post, transmit, display and distribute it for any purposes, whatsoever, without payment or other compensation to Customers. Out of respect for our Customers, Mahamosa’s general policy is to first obtain consent from Customers before using any personally identifiable information in connection with non-personally identifiable information. Mahamosa generally requires third parties to commit in writing to keep confidential all information disclosed and to use such information only for purposes of fulfilling their obligations to Mahamosa in their respective agreements with us.

Security of Customer Information

Secured Transmission of Personally Identifiable Information

Mahamosa has implemented strong physical, electronic, and procedural protective mechanisms to safeguard personally identifiable information from unauthorized access, use, or disclosure. Mahamosa uses the commercial standard secure socket layer (SSL) transmission protocol to protect and keep private the transmission of Customer Information when a Customer orders a product at Checkout. SSL is an advance technology that encrypts and secures your personally identifiable information for internet transmission. Encryption prevents third party access to personally identifiable information transmitted over the internet. Verisign is the SSL Certificate provider of choice for over 93% of the Fortune 500 and the world’s largest banks. The Verisign seal at the bottom of our homepage indicates implementation of strong security measures, including SSL. Except for those transmissions, you should assume the site is not encrypted. While we use SSL encryption to protect sensitive information in transit, we also do everything in our power to protect user-information off-line.

Credit Card Safety and Security

Your credit card information is encrypted using SSL, an advance technology that encrypts and secures your personally identifiable information, including your credit card number and other personal information, for internet transmission. Using your credit card to place an online order is much safer than using a credit card in a store or over the phone mainly because only one person will handle your credit card number is handled by one person at Mahamosa, while at a store or over the phone more than one person may handle the credit card number. At the checkout page the "http" in your browser address box should change to "https" (the s stands for secure), indicating you are on a secure page. Additionally, be sure that you are in a secure shopping zone by looking for the padlock symbol at the bottom of your internet browser. The presence of the padlock indicates that you have entered a safe shopping zone. Sometimes, an internet browser may not properly interact with our secure server, so if you do not see the padlock symbol at the bottom of your screen, please contact our Customer Service to place your order.

Firewall

Additionally, personally identifiable information is protected against unauthorized access by third parties by software called a “firewall” that acts as a barrier to third party access.

Secured Servers

We use a reputable third party hosting system. The servers on which we store personally identifiable information on are kept in a secure environment, behind a locked cage.

Limited Internal Access

Access to personally identifiable information is also limited internally. Only a few employees who must have access to Customer Information to perform a specific job have access to personally identifiable information.

Employee Privacy Policy and Security Training

We train our employees regarding this Privacy Policy and our security practices. They are familiar with and kept current on our security and privacy practices.

Customer Security Guarantee

Our goal is to make the Site as close to 100% secure for our Customers as possible and to make our Customers feel 100% safe and confident to use the Site and be satisfied with our products and services. Pursuant to The Fair Credit Billing Act (15. U.S.C. §1601, et seq., as amended) your credit card company cannot hold you liable for more than $50 of fraudulent credit card charges. In the event of unauthorized use of your credit card, you must notify your credit card provider in accordance with the Act’s reporting rules and procedures. If for any reason you are subject to any part of this $50 amount, Mahamosa will cover the entire liability up to the full $50 in cash or its equivalent in products/services, provided that your creditor has rendered a decision with respect to the charge in writing, and the unauthorized use of your credit card resulted through no fault of your own from purchases made from the Site while using our secure server. We also promise to cooperate with you in any such circumstances to find a resolution to the matter. While we haven taken extreme physical, electronic, and procedural measures to protect personal identifiable information from unauthorized access, use, or disclosure while it is under our control, it is impossible to, and we cannot, fully guarantee security of personally identifiable information as security breaches and mistakes may occur. Customer Rights, Obligations, Recommendations

Customer Access to Account Information

A Customer may correct, update or remove personal account data in a currently existing account by changing personal information at the My Account page. Please note, however, that we do not maintain all Customer Information in a form that can be accessed or updated by you and some items may not be changed (e.g., transaction records). Accordingly, we reserve the right to determine what may be accessed and how; we may also keep a record of changes (including deletions) and disclose them for lawful purposes. We keep personal information for as long as we think is necessary or advisable and we reserve the right to retain it to the full extent not prohibited by law. We may discard personal information in our discretion so you should retain your own records. Often it is not feasible or advisable to discard personal information (such as commingled personal information), so we reserve the right to retain it but treat it as inactive or discarded. Opting Out

Safe Practice Recommendations to Customers

Fraud is rampant on the internet in many forms including, but not limited to "Phishing," imposters, and fake websites. As such Customers should be aware of such fraud and should be cautious and use safe practices to protect against unauthorized access or use of their accounts. There are several safe practices we recommend

Protect password security

  1. Do not give your password to anyone else unless you intend that they have the same full access and ability to make changes to the account that you have
  2. Change your password periodically
  3. Use a unique and difficult to copy password including both letters and numbers

Email communications and online chat

  1. Do not include sensitive personal information in e-mails or online communications, because the only information encrypted is that provided by a Customer when placing an order.

Credit card information

  1. Our Customer Service will never contact you directly by phone or email to ask for your credit card information. So if you receive a phone call or email requesting credit card information DO NOT PROVIDE ANY PERSONAL OR FINANCIAL INFORMATION
  2. If you are contacted by a person claiming to be us, then you should contact us directly yourself by phone, fax or email below and let us know of such contact.
  3. Our Customer Service will only directly contact you by phone or email to confirm the details of your order if required for fulfillment.
